Except for obligations stated under this "Warranty" herein, DGTRONIX's responsibility for supplied goods ceases in accordance with EXW- DGTRONIX's site under Incoterms 2010. In the event of loss or damage during shipment, any claim shall be against the carrier only.

The supplied goods by Dgtronix are covered by a warranty against defects in material and workmanship for a period of 3 (three) months from delivery subject to the following terms and conditions:
a. Warranty for components and materials is subject to the relevant
manufacturer's warranty. Dgtronix will provide the customer any reasonable
assistance to secure and exercise the manufacturer's warranty.
b. The supplied goods will be subjected to normal use and service.
c. The warranty will cease to be effective if the goods are altered or repaired
other than by persons authorized or approved by Dgtronix.

Dgtronix's warranty and obligation under these terms are limited to the repair or replacement of defective parts, at Dgtronix's sole discretion, point of shipment, provided that a prompt notice of any defect is given to Dgtronix in writing within the applicable warranty period.

Customer shall assume all responsibility and expense for dismantling, removal, re-installation and freight in connection with the delivery of defected parts to Dgtronix. The same obligations and conditions extend to replacement parts furnished by Dgtronix hereunder.

Dgtronix makes no warranty other than as explicitly stated hereunder. All other warranties, legal, expressed or implied, including but not limited to any expressed or implied warranty of merchantability, of fitness for the intended use thereof or against infringement are hereby expressly excluded.

Dgtronix shall not be responsible or liable for any loss or damage incurred by Customer resulting from causes beyond the reasonable control of Dgtronix ("Force Majeure").

Dgtronix shall not be liable for and shall be held harmless by Customer from any damage, losses or claims of whatever kind, direct or indirect, consequential or incidental, arising out of, in connection with or resulting from the supplied goods and their sale.

Without derogating from the above, Dgtronix's liability shall be at all times limited to the Price of the relevant order of Customer.
